I think you really get issues on both sides because you have the hero characters unwilling to accept consequences at times and the villains unable to accept consequences at times.

The real issue is that these people who won't accept consequences ICly don't bother to think things through enough and see both sides of the picture. The villain definitely needs to think through their scheme enough and plan ahead to ensure continued playability. The heroes definitely need to consider what abilities their character truly has, how they apply to the game setting and what is fair to others in the game, including the villain character.

And then both sides need to work together towards a fair conclusion. The biggest thing people forget is that every character that can be played in a game is not perfect and things change when characters are uprooted into a new place (assuming not an AU game, of course). For example, most detective characters are good at what they do because they have a great deal of knowledge about their world to be able to make good deductions. But what if you have a character like Sherlock Holmes on a case with villain who kidnapped a character and teleported away to their hideout? He's likely to make a mistake there because he'd not consider teleporation as a means of escape.

Then at the same time the villain has to consider how they will plan their escape. If every hero in the game is going to be searching for the kidnapped character above, don't hide in a place people tend to frequent. That sort of plot works best with hiding somewhere far away where it would take a search party some time to get to.

That's really the main issue, both sides often forget to consider factors and overestimate capabilities and forget the fact that characters can make mistakes. Both sides have to think outside the box at times and often game settings can make it possible for a villain to get consequences and not be rendered unplayable.
