I'm definitely not an expert, but law is way more complicated than what you seem to think.

You can't just be jailed unless a prosecution can build a case against you based on testimony and evidence. You can't just up to someone and say that you did something and automatically be taken in for it. And even if he'd tried in a court of law with nothing but his words against himself, if the victim (who seems to want this to not blow up in her face) hadn't come forward and no evidence or witnesses and so forth could be found support a case against him it'd be difficult to convict him on the charges that he'd press against himself in this hypothetical scenario.

And while that may be shitty in multiple ways you won't hear me defending the idea of people being convicted without evidence. Historically speaking? Not a very successful thing when you allow that to happen.
