P.S. au art is technically copyright infringement if it's of a character the artist doesn't have written permission to portray, and profiting off of that sort of thing is technically illegal, but that's another can of worms, I know.

Pretty sure that technically roleplaying as characters from any fandom without written permission from the creators is also copyright infringement and illigal.

But we do that here anyway and nobody gives a shit.

Technically it doesn't matter (if you upload a movie to the Internet that people can download for free, you're not making money but it's still copyright infringement). While monetary gain is taken into account in copyright cases, it's usually not the factor that determines fair use.

I still think RPing is fair use and thus not illegal for the following reasons:
1) We've taken the IPs we're using out of their original context and using them in a different way, to play a game amongst ourselves.
2) We're not cutting into the source's revenue stream, since no one is going to read a random RP thread in place of seeing a movie they want to watch.

That said I'm not a lawyer, so I don't know all the laws out there. Either way I doubt any IP owner is going to waste time suing RPers.

and it doesn't matter that "it's still against copyright!" because who are they really going to go after? a bunch of people smashing their internet barbies together, or some dude trying to make money off their creations?
